Services Provided

FlyingFox Creative ("we", "us", "our") provides professional photography, videography, and/or drone services ("Services") for various purposes, including but not limited to real estate/property marketing, hotel/resort promotions, portraits, events, commercial/product shoots, or other agreed projects ("the Project"). Services include shooting on the scheduled date(s), professional editing (color correction, enhancements), and delivery of final high-resolution digital files via secure online download. Specific deliverables, scope, and fees are outlined in the quote/booking confirmation.

Booking and Payment

Book by contacting Jason via phone/WhatsApp (+230 5 482-1595) or email (jason@flyingfoxcreative.mu). Provide project details (location, type, duration, requirements). A quote will be provided; a 50% non-refundable deposit secures the date(s). Balance is due before the shoot date (or as agreed), and full payment is required before file delivery. Late payments may delay delivery or incur fees. Rush editing/delivery is available for an extra fee.

Client Responsibilities

Clients must provide full, safe access to the location(s) and any necessary permissions (e.g., property entry, hotel areas, event venues). A representative should be present or provide instructions. Sites/subjects should be prepared as discussed (e.g., decluttering for property shoots, styling for portraits/hotels). For shoots involving people, clients must obtain any required model releases/consents. Pets, people, and unauthorized items should be managed during shooting. For drone shoots, we handle all CAA/ICTA permissions and compliance.

Shoot Day, Cancellations, and Rescheduling

We arrive on time, though minor adjustments may be made for optimal results. Weather-dependent shoots (e.g., drone, outdoor portraits) will be rescheduled at no charge if unsafe. Client cancellations result in the deposit being non-refundable, and cancellations within 48 hours may forfeit the deposit entirely. No-shows or denied access may result in a full fee charge.

Delivery and Revisions

Final files are delivered 3–4 business days after the shoot (rush options available). Basic edits are included; major revisions may incur additional fees. Files are provided in high-resolution JPEG (photos) and/or MP4 (videos) via secure download link.

Usage Rights Granted

Upon full payment, the client receives a worldwide, perpetual, non-exclusive, royalty-free license to use the final delivered photos and videos for the agreed commercial or promotional purposes related to the Project. This includes real estate listings, hotel promotions, websites, social media, advertising, brochures, portfolios, and other specified uses. Clients may reproduce, distribute, display, and modify the files as needed. FlyingFox Creative retains all copyright and moral rights and may use the work for portfolio or promotional purposes (without personal identifiers if preferred). Any use outside the agreed scope (e.g., resale, unrelated advertising, third-party transfer) requires written permission and may involve additional fees. Rights cannot be sublicensed or assigned without approval.

Copyright and Ownership

We retain full copyright in all images/videos from the time of creation (per the Mauritius Copyright Act 2014). The granted license provides usage rights only; no copyright transfer occurs. Unauthorized use beyond the license constitutes infringement.

Model Releases and Third-Party Rights

For shoots involving identifiable people, we can provide standard model release forms if needed. Clients are responsible for obtaining any required consents for commercial use. We are not liable for claims arising from the client’s use of images without proper releases.

Liability and Indemnity

We are not liable for any loss, damage, or injury during shoots unless caused by our gross negligence. Clients indemnify us against claims from third parties (e.g., access issues, permissions, model consents). Services are provided “as is,” with no warranties beyond professional standards. Maximum liability is limited to the fees paid for the Project.

Force Majeure

We are not liable for delays or cancellations caused by weather, illness, equipment failure, government restrictions, or events beyond our control.

Governing Law

These terms are governed by Mauritian law. Any disputes will be resolved in the Mauritius courts.

Acceptance

By booking, paying the deposit, or proceeding with the shoot, you agree to these Terms and Conditions. Updates may occur, but the current version remains in effect.
